1. Acceptance of these terms
These terms and conditions govern your use of gemhome (the “Service”), available at gemhome.co.uk. By accessing or using the Service, you agree to be bound by these terms. If you don't agree with them, please don't use the Service.
2. What gemhome does
gemhome is a property due-diligence tool for people buying or renting homes in the United Kingdom. You give us a property, either by pasting a link to a Rightmove or Zoopla listing or by entering a postcode and house number, and we produce a one-page appraisal. That appraisal draws together free UK public records, including the EPC register, HM Land Registry sold prices, ONS private-rent statistics, police.uk crime data, Environment Agency flood and landfill data, Defra noise mapping, Ofcom broadband coverage, ONS and MHCLG deprivation and census data, DfE schools data, planning data, and radon and coal information. Where a listing exists, we also generate an AI-written summary of the photographs and the data. We also offer a free rent-increase checker, a free rent-rise evidence pack and a free seller report, described in section 9.
3. Informational only, not advice
The appraisal is provided for general information only. It is not financial, legal, mortgage, valuation, tax, or investment advice, and nothing in it should be treated as a recommendation to buy, not buy, let, or pay a particular price for any property. This applies equally to the landlord and buy-to-let views and the area yield pages: figures such as rent estimates, gross and net yields, cash flow, lender stress tests, break-even growth, loan-to-value scenarios and renovation costs and uplifts are estimates computed from public data and stated assumptions. They are not valuations, forecasts or promises, and actual outcomes, rents, costs and lending decisions will differ. gemhome is not authorised or regulated by the Financial Conduct Authority and does not recommend, arrange or advise on mortgages or any regulated financial product. You should not make a purchase, letting or financial decision solely on the basis of a gemhome appraisal.
4. Not a substitute for professional due diligence
A gemhome appraisal is not a substitute for, and does not replace, a professional survey, a RICS valuation, a solicitor's conveyancing searches, a mortgage lender's assessment, or your own independent due diligence. Before committing to a purchase you should always instruct suitably qualified professionals. Estimated figures, in particular off-market valuations and bedroom counts, are estimates only and may be wrong.
5. Accuracy and “as is” data
The information in an appraisal is drawn from third-party public sources. That data may be incomplete, out of date, or contain errors, and public records aren't always kept current by the bodies that publish them. The Service and everything in it is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including as to accuracy, completeness, or fitness for a particular purpose. We don't warrant that the Service will be uninterrupted or error-free.
6. Acceptable use
You agree to use the Service only for lawful purposes and:
- for your own personal, non-commercial use in connection with buying or renting a home;
- not to scrape, harvest, bulk-download, or systematically extract data from the Service;
- not to overload, disrupt, probe, or otherwise abuse the Service or the infrastructure it runs on;
- not to resell, redistribute, or commercially exploit appraisals or their contents without our written permission;
- not to use the Service in any way that breaches the terms of the underlying data sources or any applicable law.
7. Intellectual property
The gemhome name, branding, page design, written analysis, scoring, and the way information is presented are owned by us or our licensors and are protected by intellectual property law. You are given a limited, personal, non-transferable right to view and use appraisals and packs for your own home-buying or renting purposes. All other rights are reserved.
8. Third-party data
The underlying public records remain the property of, and are provided under the terms of, their original sources, including HM Land Registry, the Environment Agency, the Office for National Statistics, MHCLG, the Department for Education, Ofcom, police.uk, and others. Much of this data is published under the Open Government Licence or similar terms. gemhome does not claim ownership of that underlying data.
9. Price
gemhome is free. Property reports, rent-increase checks, rent-rise evidence packs and seller reports cost nothing, and there is no account, card or subscription. We may charge for new products in future, and if we do, the price will be shown before you buy anything.
If you bought a check pass or a subscription before we made everything free, that pass still works and you are not charged again. Nothing you already paid for has been taken away.
The rent-rise evidence pack is signposting and evidence built from official public data. It is not legal advice, we are not a law firm, and using it does not create a solicitor-client relationship. Tribunal outcomes depend on your circumstances and are never guaranteed. Deadlines shown are calculated from the dates you enter, so check them against your own notice.
10. Limitation of liability
To the fullest extent permitted by law, gemhome and its operators will not be liable for any loss or damage, whether in contract, tort (including negligence), or otherwise, arising out of or in connection with your use of, or reliance on, the Service or any appraisal. This includes, without limitation, any decision to buy or not to buy a property, any price paid, or any indirect or consequential loss.
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. For paid products, our total liability is limited to the price you paid for the product concerned. Your statutory rights as a consumer under UK law are not affected.
11. Changes to the Service and these terms
We may change, suspend, or withdraw any part of the Service, and we may update these terms from time to time. The current version will always be posted on this page with the date it was last updated. Your continued use of the Service after a change takes effect means you accept the revised terms.
12. Governing law
These terms are governed by the law of England and Wales, and any dispute relating to them or to the Service will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
